Spellbound Book Art Terms & Conditions 2020

By paying any amount to Spellbound Book Art, in the form of either a deposit or the full cost of the item upfront, you are agreeing to the following Terms and Conditions.

Placing an order:

  • Potential orders can be discussed online via email (info@spellboundbookart.co.uk), using the contact form on the website, or via the messenger system on the Spellbound Book Art Facebook page. All other means of initial enquiry will be directed to one of these means of communication in order to further discuss any ideas or requirements and to complete the order process, unless explicitly agreed otherwise.

  • The suitability of any and all book sculpture design requests will be at the sole discretion of Spellbound Book Art. Viability of certain design elements cannot be guaranteed (such as fine details which would be too small to be legible on a book sculpture), but any potential problems will be discussed in full at the soonest available opportunity and a more suitable alternative will be suggested wherever possible.

  • Where Spellbound Book Art advises that a particular design request is not practically feasible due to the nature of the book folding process, it is your responsibility to either heed this advice and agree upon a more suitable alternative, or accept the consequences of an illegible or otherwise imperfect design. Spellbound Book Art cannot be held responsible for any discrepancies in quality which you were directly warned about in advance.

  • Item and production specifics must be requested and agreed on in full before any design or production work begins, including, but not limited to: any initial design ideas, names/dates/words required, approximate budget, purpose of book sculpture (ie. birthday, graduation, portrait etc.), reference images and required delivery date. Any alterations requested or changes made beyond this point may incur additional fees.

  • A partially-refundable £40 deposit must be paid before any design work commences for all customised designs (not applicable for pre-designed or non-customised designs), and the full balance must be cleared before production of the book sculpture itself commences.

  • Upon payment of the £40 deposit (customised designs only), Spellbound Book Art will begin work on a range of differently priced designs, varying in complexity, to cater to the budget range you identified during the initial discussion stages. These will usually be supplied within 48 hours (within a couple of hours in many cases) but any potential delays to the design process will be outlined before a deposit is requested.

Prices and Payments:

  • Unless otherwise agreed, all online payments will be requested (via invoice), and processed, via Paypal. Please visit www.paypal.com for more information.

  • Prices quoted for each design include any applicable initial design work, one basic revision (at the sole discretion of Spellbound Book Art eg. a simple font change or resizing of a design element), and the production of the book sculpture itself.

  • Should additional edits be required, they will be priced approximately £5 - £15 per edit (depending on the amount of work involved for each one) and added to the final total.

  • If you accrue more than £20 worth of additional revision fees before committing to the final design and paying the outstanding balance in full, a further £20 deposit will be required in order to continue making further revisions. This process will repeat until you are satisfied with the final design.

  • All deposits paid will be deducted from the total outstanding balance.

  • The outstanding balance must be paid in full before any production work commences on the book sculptures themselves, including the marking of the patterns and the cutting/folding stages.

  • Spellbound Book Art cannot be held accountable for production delays caused by late payments. It is your responsibility to ensure you have paid any monies owed promptly enough to allow for the production and dispatch of any and all book sculptures in line with your required delivery date and the production timescales set out below.

  • Any late or non-agreed partial payments will stall the respective design or production stages to which they relate, and this work will not commence until the requested amount has been paid in full.

  • If deposit invoices have not been paid in full within 30 days of receipt, Spellbound Book Art reserves the right to cancel the order.

  • If you do not select your chosen design from those provided and pay the outstanding balance invoice in full within 30 days of receipt of the designs, Spellbound Book Art reserves the right to cancel the order and you will forfeit your entire £40 deposit.

Timescales:

  • In general, the initial set of designs will be created and provided within 48 hours (within a couple of hours in many cases), but this may take longer during busy periods, or times when there is a backlog of orders. Any potential delays to the creation of the designs will be highlighted before a deposit is requested.

  • Any edits or revisions (both the inclusive ones and any additional fee-incurring ones) will be undertaken within the same timeframe as the initial design work, providing you respond to any communication in a reasonably timely manner. Spellbound Book Art cannot be held responsible for any delays caused by slow responses to design revisions or any other form of communication.

  • Production of the book sculptures themselves vary depending on complexity, but in general take around 7 - 10 working days to produce. This may take longer during busy periods, or times when there is a backlog of orders. Any potential delays to the production stage of the book sculpture will be highlighted before full payment is requested.

Delivery:

  • All Spellbound Book Art book sculptures sent within the UK will be sent via Option 1: Royal Mail First Class Recorded Delivery, at a cost of £5.95 per book sculpture; or Option 2: Royal Mail Next Day Guaranteed Delivery at a cost of £9.95 per book sculpture.

  • Any offer of international postage will be at the discretion of Spellbound Book Art, and prices for acceptable destinations will be discussed on a case-by-case basis.

  • It is your responsibility to pay for any potential import fees or customs charges associated with international deliveries.

  • All items will be dispatched as soon as the production stage is complete but Spellbound Book Art cannot be held responsible for any unforeseen delays within the postal system. It is your responsibility to make sure you allow enough time for design, production and delivery if you need the book sculpture to arrive before a certain date. Spellbound Book Art cannot be held responsible for any missed delivery dates if the order was not placed within the reasonable timeframe set out above.

  • Each Spellbound Book Art book sculpture will be wrapped in cellophane, bubble wrap and tissue paper, securely packaged in its own customised, branded gift box, and enclosed within a water-resistant mailing bag to ensure it reaches you in perfect condition.

  • In general, orders are accepted on a 'first come, first served' basis.

  • If an order is required in a shorter space of time than set out above, Spellbound Book Art may offer a discretionary 'Priority' service for a fee of £10, but this will only be offered if the required delivery date is practically and logistically feasible, and only if there are no other previously placed orders which would be unfairly delayed as a result.

Returns:

  • Due to the customised nature of the majority of Spellbound Book Art's book sculptures, returns cannot be accepted for any customised items (unless damaged or faulty).

  • Returns of non-customised products that have the potential for re-sale elsewhere (eg. a heart, a generic flower, the word 'Mum' etc.) are at the sole discretion of Spellbound Book Art and are not guaranteed to be accepted without good reason.

  • In the case of a return request being accepted, the buyer will be solely responsible for the initial delivery and return postage costs. The item cost will be refunded in full as long as it arrives in the same condition it was sent out, including all original packaging, and it must be in a re-saleable condition. If these conditions are not met, Spellbound Book Art reserves the right to consider a partial refund only, depending on the extent of the problem.

  • Returns will only be considered and a refund processed upon receipt of the book sculpture in question.

  • Returns must be arranged within 14 days of receipt.

  • In the unlikely event that an item arrives damaged or faulty, Spellbound Book Art will re-produce and resend a duplicate item (wherever possible) free of charge upon receipt of photographic evidence of the problem.

  • If the damaged or faulty item was produced using a specific book title that you provided or requested and another copy of the same book cannot be sourced, Spellbound Book Art will reproduce the design in a 'Made For Purpose' book, send it free of charge, and also offer a discretionary partial refund.

Cancellations and Refunds:

  • You are free to cancel your order at any stage of the initial design process, but in doing so you will forfeit half of your deposit and receive a partial refund of £20. If you cancel after any fee-incurring revisions have been made to the initial set of designs provided you will also forfeit the applicable cost of these fees. This is to cover the design work that will have been done regardless of whether or not you follow through with the book sculpture order.

  • Due to the customised nature of the majority of Spellbound Book Art's book sculptures, once you have chosen your preferred design from those provided and committed to the production stage of the process by paying the outstanding balance in full, cancellations or alterations will no longer be possible.

  • In the highly unlikely event that Spellbound Book Art has to take the decision to cancel an order (eg. illness, injury, bereavement, an abusive customer etc.) any and all payments made up until that point will be refunded in full, thus releasing Spellbound Book Art from any obligations to carry out the project in question. In the event of a temporary problem (eg. minor injury), it is entirely at your own discretion as to whether or not you wish to reinstate the process further down the line. This will be discussed and agreed upon on an individual, case-by-case basis.

Designs and Copyright:

  • Any reference photographs provided for portraits will be used 'as seen' and any edits you may request (such as altering someone's hairstyle, clothing or positioning within the scene etc.) will be at the sole discretion of Spellbound Book Art, and may incur additional fees.

  • The accuracy of any names, dates, ages or other information you request to be part of your design are your sole responsibility, and Spellbound Book Art cannot be held accountable for any errors noticed after you have approved your chosen design.

  • Any and all book sculpture designs provided, along with all graphics, wording and photography on the website and social media channels, and designs and content of the 'made for purpose' books, are the sole property of Spellbound Book Art. Using or publicly sharing any part of these for your own purposes without prior permission from Spellbound Book Art is strictly prohibited.

  • Any and all book sculpture designs provided during the ordering process are for illustrative purposes only, and must not be published or shared elsewhere for any reason.

  • Spellbound Book Art holds the copyright to all designs provided and using them to create your own patterns for personal or commercial use, sharing them with someone else to create a pattern for you for this same purpose, or selling them for personal or commercial use by anybody else is strictly prohibited.

  • Spellbound Book Art reserves the right to re-use any and all design elements in future designs, and may re-use entire designs where applicable.

Book use:

  • Unless otherwise requested or stated, all Spellbound Book Art book sculptures will be crafted using one of the exclusive 'made for purpose' books.

  • If a specific book title is requested, Spellbound Book Art will assess its suitability and honour the request wherever possible. In order to be suitable, any books provided must contain at least 400 pages, be hardback, and be within 180-220mm tall. No guarantees can be made as to the suitability of any specific requests.

  • If your chosen title is accepted as suitable and you already have it in your possession, it is your responsibility to provide Spellbound Book Art with the book using a secure method of delivery, at your own cost. The address to send it to will be provided upon request.

  • If you do not have the book in your possession, you can either: source/obtain it yourself and use the method outlined above to get it to Spellbound Book Art; source it online and have it sent directly to Spellbound Book Art; or provide clear instructions as to the exact book you require so that Spellbound Book Art can source it directly. All methods are discretionary and must be discussed in full prior to any agreements being made.

  • It is your responsibility to ensure you use a secure delivery service when sending books to Spellbound Book Art. Spellbound Book Art cannot be held responsible for the loss or delay of any books you send in.

  • Any and all books used for the making of book sculptures is entirely at the discretion of Spellbound Book Art, and will be considered and discussed on a case-by-case basis.

Website and Social Media

  • By commissioning and purchasing a Spellbound Book Art book sculpture, you are agreeing to any images of the finished product being shared freely by Spellbound Book Art on the website, Instagram, Facebook and Twitter accounts. These will only ever be shared once the recipient has received their book sculpture, and Spellbound Book Art will always check this before doing so.

  • Any reference photographs or images you have provided for your designs may, on rare occasions, be used online alongside the related finished book sculpture for production process demonstration purposes. If you do not wish any of your reference material to be shared publicly, you must inform Spellbound Book Art before the production stage begins.

  • You are free to share your own photographs of your Spellbound Book Art book sculpture on the Spellbound Book Art Facebook page.

  • If you share any images or videos of Spellbound Book Art's book sculptures anywhere online, you must credit Spellbound Book Art directly.
